Acceptance of these terms

These Terms of Service ("Terms") apply to your use of the Verix Energy website and to any solar consultation, proposal, or related service you request from Verix Energy LLC ("Verix Energy," "we," "us," or "our"). By using this website or requesting a consultation, you agree to these Terms. If you do not agree, please do not use the site or request a consultation.

What we do

Verix Energy is a residential solar sales and consultation company based in Gilbert, Arizona, serving homeowners across Arizona. We help homeowners evaluate solar and battery storage, prepare proposals sized to their home and usage, and coordinate the project through to installation.

Verix Energy is a solar sales company and is not a licensed contractor. Installations are completed by licensed, ROC-certified Arizona contractors. Financing, lease, and power purchase agreement (PPA) products are provided by third-party providers under their own agreements and terms.

No guarantees on pricing, savings, or production

Any figure we share before you sign a contract, including estimated pricing, estimated savings, system production, payback period, or utility rate assumptions, is an estimate for discussion purposes only. It is not an offer, a quote you can rely on, or a guarantee.

Actual results vary based on your roof, shading, orientation, energy usage, system design and size, equipment selected, utility rate plan and any future changes to it, financing terms, and factors outside our control. Verix Energy does not guarantee any specific savings, production, price, or payback.

Only a signed written agreement between you and the applicable contractor or financing provider sets binding pricing and terms. Financing, lease, and PPA options are subject to credit approval and provider terms.

Your responsibilities

• Provide accurate and complete information about yourself and your property. Our proposals depend on it.
• Confirm that you are at least 18 years old and are the homeowner, or are authorized to act for the homeowner.
• Provide a phone number that belongs to you, or that you are authorized to give us consent for. See our Privacy Policy for how we handle calls and text messages.
• Use this website lawfully, and do not attempt to disrupt, misuse, or gain unauthorized access to it.

Communications and consent

When you give us your phone number, verbally or through a form on our website, you agree that we may contact you by phone, text message, and email about your solar inquiry. Message frequency varies. Message and data rates may apply. Reply STOP to opt out of text messages, and reply HELP for help. Consent to receive marketing text messages is not a condition of any purchase.

How we collect, use, and protect your information, including our commitment that mobile phone numbers and SMS consent are never sold, rented, or shared with third parties or affiliates for their marketing purposes, is described in our Privacy Policy.

Intellectual property

The content on this website, including text, graphics, logos, the Verix Energy name and lion emblem, and page design, is owned by Verix Energy or its licensors and is protected by applicable law. You may view and share the pages for personal, non-commercial purposes. You may not copy, reproduce, or use our branding or content commercially without our written permission.

Third-party links and services

This website links to third-party services, including our quote and application forms and our installation and financing partners. We do not control those services and are not responsible for their content, availability, or practices. Their own terms and privacy policies apply when you use them.

Disclaimer of warranties

This website and the information on it are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error free, or free of harmful components, or that the information on it is complete or current.

Equipment warranties, where they exist, are provided by the equipment manufacturers, and workmanship warranties are provided by the installing contractor, each under their own terms.

Limitation of liability

To the fullest extent permitted by Arizona law, Verix Energy and its owners, employees, and representatives will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, lost savings, or loss of data, arising out of or relating to your use of this website or any pre-contract consultation, proposal, or estimate, even if we have been advised of the possibility of those damages.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to this website or a pre-contract consultation will not exceed one hundred dollars ($100). Nothing in these Terms limits any liability that cannot be limited under applicable law. This section does not apply to obligations under a separate signed agreement, which are governed by that agreement.

Indemnification

You agree to indemnify and hold harmless Verix Energy and its owners, employees, and representatives from any claims, damages, losses, and reasonable costs arising out of your misuse of this website, your violation of these Terms, or your submission of information you were not authorized to provide, including a phone number you did not have authority to give consent for.

Governing law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law rules. Any dispute arising out of or relating to these Terms or this website will be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to the jurisdiction of those courts.

Changes to these terms

We may update these Terms from time to time. When we do, we will change the "Last updated" date at the top of this page. Your continued use of the website after a change means you accept the updated Terms.
